TERMS OF SERVICE

📜 1. Intellectual Property & Proprietary Rights

All source code, compiled binaries, fluid dynamics algorithms, thermodynamics formulas, and gating system optimization logic within the Software are the exclusive proprietary property of Josecast. You are strictly prohibited from decompiling, reverse engineering, adapting, or extracting the mathematical models to build competing automation tools or web utilities.

🔑 2. License Grant & Permitted Use

Subject to full payment of the one-time perpetual license fee ($100 USD), Josecast grants you a non-exclusive, non-transferable, lifetime license to install and execute the Software on your local workstation. This license covers commercial use within foundry operations and design engineering departments to calculate gating cross-sectional areas, ideal filling times, and riser dimensions. Renting, sublicensing, or redistributing the installer package to third parties is strictly forbidden.

⚠️ 3. Absolute Limitation of Liability (Engineering Risk)

Josecast Suite is an analytical optimization tool engineered to reduce time overhead before 3D simulations. However, physical foundry operations depend on highly volatile empirical variables (e.g., exact metal chemistry, real-time pouring temperatures, mold permeability, and friction factors). Therefore, the Software is provided on an "AS-IS" basis.

To the maximum extent permitted by law, Josecast shall not be held liable for any physical manufacturing failures, casting defects (porosity, dross, shrinkage cavities), destroyed molding sand, wasted furnace energy, facility downtime, or resulting financial losses. The final engineering verification and shop-floor manufacturing risks remain the sole professional responsibility of the user.

💳 4. Merchant of Record & Billing

All financial transactions, license fee processing, and tax/VAT collection for Josecast Suite are securely managed by Paddle (paddle.com), acting as our official Merchant of Record (MoR). By initiating a purchase, you agree to comply with Paddle’s checkout terms and regional tax protocols.
